BOOKING CONDITIONS for the Villa Maroulas

Holiday villa in Crete

Certified by the Greek Ministry of Tourism

 

1. GENERAL

Bookings conditions are attached to the Villa Maroulas website certified by EOT, or as otherwise agreed upon by both parties and specified in the private contract.

 

2. FORMATION OF CONTRACT

2.1 Before making a booking, the Guest must contact the Property Owner of the holiday villa in Crete to obtain confirmation that the property is available for the dates required. The Guest must send the Property Owner of the holiday villa in Crete a completed and signed booking form and payment of a deposit of 30% of the total property rental. A binding contract between the person who has signed the booking form and the Property Owner of the holiday villa in Crete will be made when the Property Owner of the holiday villa in Crete issues a confirmation invoice. The Guest is responsible for payment of the price of the holiday and the compliance of the members of his party with these conditions.

2.2 Bookings cannot be accepted from persons less than 18 years of age at the time of booking. The Property Owner of the holiday villa in Crete reserves the right to refuse a booking without giving any reason.

 

3. PAYMENT

3.1 The balance must be paid no later than 30 days prior to arrival. Failure to pay the balance on time will constitute cancellation and cancellation charges will become payable in accordance with paragraph 8.

3.2 If the Guest books a holiday less than 30 days prior to arrival, the full holiday charge is payable at the time of booking.

3.3 Receipt and banking of any deposit shall constitute acceptance of any booking: a binding contract exists when the Property Owner of the holiday villa in Crete issues a confirmation invoice.

 

4. MINIMUM RENTAL PERIOD

4.1 There is a minimum stay of one week, from Saturday to Saturday. In some cases, less than one week rentals may be arranged.

 

5. THE PRICE

5.1 The prices are given in Euros and the rental period is weekly, unless otherwise stated. Clients may make bookings in either Euros, dollars, or pounds sterling as long as the amount is equivalent to the amount quoted in Euros. The deposit and balance must be made in the same currency.

5.2 The property is let fully furnished and equipped. The price includes linen, cleaning, and services as indicated in the property description. Additional facilities and services are stated in the website.

 

6. SECURITY DEPOSIT 6.1 When the keys are handed over to the Guest, the security deposit, as indicated in the Villa Maroulas in Crete Price List, must be paid in cash and in EURO to the Property Owner of the holiday villa in Crete or his representative. This amount will be refunded to the Guest at the end of the holiday less any deduction made for any damage caused to the property or its contents or for any additional costs that were not included in the rental price. Should the Guest decide to leave the property prematurely the Property Owner of the holiday villa in Crete or his representative is authorized to refund the deposit to the Guest by post (Less any deductions made for damages or any additional expenses) and only after having checked the inventory and the property in question.

 

7. ALTERATIONS OR CANCELLATION BY THE PROPERTY OWNER 7.1 In the unlikely event that it is necessary to make an alteration to or cancel the holiday accommodation specified in the holiday confirmation, the Property Owner of the holiday villa in Crete will try to arrange alternative holiday accommodation of a similar type and standard and in a similar location as that originally requested. 7.2 If the alternative holiday accommodation is not acceptable, the Property Owner of the holiday villa in Crete will refund in full the money.

 

8. CANCELLA TION BY YOU 8.1 Any cancellation by the Guest (for whatever reason) must be by e-mail or by post, in writing addressed to the Property Owner of the holiday villa in Crete. The effective date of cancellation is the date on which written notification is received by the Property Owner of the holiday villa in Crete. 8.2 If the Guest cancels 4 weeks or more before arrival, the deposit will not be refunded. 8.3 If the Guest cancels within 4 weeks prior to arrival, or if the booking is cancelled by us due to non-payment, the Property Owner of the holiday villa in Crete shall be entitled to the full holiday cost from the Guest.

 

9. AMMENDMENTS BY YOU

Upon receipt of your booking invoice, please check the details to make sure they are correct.

 

10. INFORMATION

10.1 Of course the Property Owner of the holiday villa in Crete makes every effort to ensure that descriptions are accurate the Guest must accept that minor differences between the photograph text and actual property may arise. 10.2 The Property Owner of the holiday villa in Crete reserves the right to make modifications to the property specifications that are considered necessary in the light of operating requirements. In the interests of continued improvement, the Property Owner of the holiday villa in Crete reserves the right to alter furniture, fittings, amenities, facilities or any other activities, either advertised or previously available, without prior notice.

 

11. NUMBER OF PEOPLE USING THE HOLIDAY ACCOMMODATION

Only those persons named on the booking form may use the property without prior arrangement. The number of people staying at the property must not exceed the number of sleeping places indicated in the property description except in the case of infants less than two years. In the event that the maximum number is exceeded without prior arrangement, the Property Owner of the holiday villa in Crete reserves the right to refuse or revoke the booking at their sole discretion.

 

12. ACCESS

The Property Owner of the holiday villa in Crete or his/her representative shall be allowed free access to the holiday accommodation at any reasonable time during any holiday occupancy for the purposes of inspection and maintenance.

 

13. ARRIVAL AND DEPARTURE

The Guest must advice as soon as possible about his arrival time. In some case, the Property Owner of the holiday villa in Crete may ask the guest to arrive a few hours later, time to clean and prepare the villa Maroulas. If your arrival is delayed the Guest must inform the Property Owner of the holiday villa in Crete so that suitable arrangements can be made for entry to the holiday accommodation. In the event that the Property Owner of the holiday villa in Crete or his representative cannot be contacted and it is not possible to advise the Property Owner of the holiday villa in Crete or his representative for the delay, in the event that the arrival was not previously advised or in the event that the Property Owner of the holiday villa in Crete cannot accept a late arrival, the Guest alone is responsible for the cost of the overnight stay in a hotel.

 

14. PETS

Pets are not allowed without asking permission to the Property Owner of the holiday villa in Crete. The Guest may be asked for an additional Security deposit.

 

15. YOUR RESPONSIBILITIES

The Guest must keep the holiday accommodation and all furniture, fittings, effects, facilities and equipment in the some state of repair and condition as at the commencement of the holiday, and leave the holiday accommodation in the same state of cleanliness and general order in which it was found. The Guest is responsible for all damage or loss which occurs to the property or its contents during his occupation, and will be responsible to paying appropriate compensation to the Property Owner of the holiday villa in Crete direct in the event of breakages or damage.

 

16. RESPONSIBILITIES OF THE PROPERTY OWNER

16.1 The Property Owner of the holiday villa in Crete shall not be responsible for the death of or personal injury of the Guest or any person named on the Booking Form or other person at the property, unless this results from the proven negligence of the Property Owner of the holiday villa in Crete, or our employees.

16.2 The Property Owner of the holiday villa in Crete shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control, including though not limited to, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, by laws, or measures of any kind on the part of any governmental or local authority, strikes, lock-outs, or other industrial actions or disputes or adverse weather conditions. In any such case, the Property Owner of the holiday villa in Crete shall be entitled to treat the contract as discharged.

16.3 In the event of such discharge, our liability shall be limited to the return of the sums paid to the Property Owner of the holiday villa in Crete in respect of the (unused) portion of the holiday calculated on a prorata daily basis.

16.4 The Property Owner of the holiday villa in Crete cannot be held responsible for breakdown of mechanical equipment such as pumps, boilers, swimming pool filtrations systems etc. nor for failure of public utilities such as water, gas and electricity. 16.5 The Property Owner of the holiday villa in Crete is not responsible for noise or disturbance originating beyond the boundaries of the holiday accommodation or which is beyond the Property Owner's control.

 

17. BEHAVIOUR

The person signing the contract is responsible for the correct and decent behaviour of his party. Should the Guest and his party not behave in such a manner the Property Owner of the holiday villa in Crete or his representative may at his absolute discretion ask the Guest and his party to vacate the property without a refund.

 

18. STAFF

The services of some staff are included. Some services are payable locally. Additional maids and cooks are available at extra charge, although such services cannot be guaranteed. Please give the Property Owner of the holiday villa in Crete as much notice as possible and the Property Owner of the holiday villa in Crete shall try to do it. The Property Owner of the holiday villa in Crete accepts no responsibility for additional staff or services. Any other arrangements the Guest makes with his staff or any other person or company providing services whilst the Guest is staying at the property are between the Guest and the staff.

 

19. LINEN

Linen is included but it is advisable to take beach towels and cot linen. Linen is normally changed every 2 or 3 nights.

 

20. SWIMMING POOL

In Europe, swimming pools are usually closed during the winter months. If your rental falls outside the period 1st April to 30th October, please check with the Property Owner of the holiday villa in Crete that the pool is open. There is no pool heating.

 

21. SOCIAL EVENTS AND OTHER FUNCTIONS

The Property Owner of the holiday villa in Crete does not allow social events and other functions (e.g. weddings, receptions, large cocktail parties) on the property without prior agreement at the discretion of the Property Owner of the holiday villa in Crete. Permission will be required for any event with more than 12 people. If permission is granted, an additional fee may be charged.

 

22. SECURITY AND VALUABLES

Any valuables left at the property are left at the Guest's risk. The Property Owner of the holiday villa in Crete is not responsible for their loss. As with all rental properties in prime locations, there may be a risk of burglary. The Property Owner of the holiday villa in Crete accepts no responsibility for any loss, damage or any other security related incident howsoever caused.

 

23. INSURANCE

The Property Owner of the holiday villa in Crete has liability insurance and guests living in the house are insured against fire, flood, and earthquake.

 

24. LAW

All contractual obligations arising out of these booking conditions shall be deemed to come into existence in Rethymno, and would be subject to Greek law and the exclusive jurisdiction of the Greek courts.
